California's Penalties for DUI
Even if you are convicted of DUI, it does not mean that you will spend time in jail. In most cases, a defendant may spend one or two days before being released on bail or their own recognizance. However, for individuals who have previous offenses, the potential for jail time may be much higher.
California may enforce the following jail time for DUI offenses:
- 4 days to 6 months for a first offense
- 90 days to 1 year for a second offense
- 120 days to 1 year for a third offense
- 180 days to 1 year for a fourth offense
- 16 months if convicted of a fourth within 10 months of your third offense
Other factors are also taken into consideration when determining punishment for DUI. For example, if you had a child under a certain age in the vehicle or had an extremely high BAC, your penalties and jail time may be increased.
