Indecent Exposure Defense in Ventura

Your Defense Draws on a Former Senior Deputy District Attorney’s Perspective

An indecent exposure allegation turns on more than whether exposure occurred. The prosecution must prove willful conduct, the required sexual intent, and every other element of the charge. At Law Offices of Adam L. Pearlman, I evaluate those issues using the perspective I gained during nine years as a Senior Deputy District Attorney in the Ventura County District Attorney’s Office.

I have practiced law for more than 25 years and handled cases ranging from misdemeanors to complex felonies. I personally assess the evidence, charging decisions, and defense options in each indecent exposure case.

What California Penal Code 314 Requires

The statute makes willful and lewd exposure of a person’s private parts a crime when it occurs in a public place or where other people are present who could be offended or annoyed. Willful exposure means the act was intentional rather than accidental. Lewd intent means an intent to direct public attention to the genitals for sexual gratification or to sexually offend another person.

CALCRIM 1160, the standard California jury instruction for this charge, identifies what prosecutors must prove. The elements include intentional genital exposure, the presence of someone who could reasonably be offended or annoyed, and the specific sexual intent described above.

The genital-exposure requirement matters. Revealing underwear or exposing a bare female breast, without genital exposure, doesn’t satisfy that element. The statute is also distinct from Penal Code 647(a), which addresses certain alleged lewd conduct in public. The conduct described by witnesses and the supporting evidence determine which charge is at issue.

Penalties for Indecent Exposure in Ventura

A first offense is generally a misdemeanor. A conviction can carry up to six months in county jail and a fine of up to $1,000. It can also require sex offender registration, even for a first-time misdemeanor conviction.

Aggravated indecent exposure involves alleged exposure after entering an inhabited dwelling, trailer coach, or building without consent. It’s a wobbler, meaning prosecutors may charge it as either a misdemeanor or felony. A felony conviction can carry a prison term of 16 months, two years, or three years, plus a fine of up to $10,000.

California’s registration tiers include:

  • Tier One: A minimum registration period of 10 years
  • Tier Two: A minimum registration period of 20 years
  • Tier Three: Lifetime registration

Indecent exposure is generally classified as a Tier One offense under the registration system created by SB 384. Completing the minimum period doesn’t automatically end registration. A person in Tier One or Tier Two must petition the superior court for termination, and the district attorney may oppose the petition.

Defense Issues in an Indecent Exposure Case

I test every statutory element against the evidence. A conviction requires both willful exposure and lewd intent. Accidental exposure, including a wardrobe malfunction, doesn’t establish willful conduct.

Intent must be proven separately from nudity. In In re Smith, the court held that nudity without lewd intent doesn’t violate the indecent exposure statute. For example, nude sunbathing on an isolated beach without an attempt to draw attention doesn’t establish the required sexual intent.

Other issues include whether anyone was present who could reasonably have been offended or annoyed and whether witnesses reliably identified the accused. Mistaken identity can be central when observations were brief, visibility was poor, or descriptions conflict. I examine witness statements and available recordings rather than treating an accusation as proof.

What Happens After an Arrest or Citation in Ventura

Criminal cases arising in Ventura are heard at the Hall of Justice, part of the Ventura County Superior Court. The first appearance is generally the arraignment, where the court addresses the charge and a plea is entered. The course of the case depends on the alleged offense, the evidence, procedural issues, and the surrounding facts.

I personally review police reports, body camera footage, recordings, and messages provided through discovery, the formal exchange of case evidence. I also examine whether police had a lawful basis for any stop or detention. This review can reveal conflicts between witness accounts, missing context, or legal issues affecting how evidence may be used.

Common pretrial stages include:

  • Arraignment: The court states the charge and addresses the plea and release conditions.
  • Discovery Review: I assess the evidence disclosed by the prosecution.
  • Negotiation: I discuss the case with the Ventura County District Attorney’s Office when negotiation serves the defense strategy.
  • Early Disposition Conference: Local misdemeanor cases typically proceed to this conference or move to a trial-setting department after arraignment.
